Acceptable Use Policy

Effective: May 26, 2026

This Acceptable Use Policy (the “AUP”) supplements our Terms of Service and forms part of your agreement with Big Spawn LLC (“Big Spawn”, “we”, “us”, or “our”). By using any of our products or services (collectively, the “Services”), you agree to comply with this AUP and with our Payment Processor's acceptable use policy, available at polar.sh/docs/policies/acceptable-use. Where the two policies differ, the more restrictive policy applies.

We may suspend or terminate accounts that violate this AUP, with or without notice depending on the severity of the violation, and we will cooperate with law-enforcement and regulatory requests where appropriate.

Prohibited Content and Uses

You agree not to use the Services to engage in, host, promote, facilitate, or transact in any of the following:

  • Illegal activity. Any activity that would be a crime under U.S. federal or state law in the jurisdiction where you reside or operate, or under the law of any jurisdiction in which your customers reside, including (without limitation) money laundering, terrorist financing, human trafficking, drug trafficking, or sanctions evasion.
  • Adult or sexually explicit content. Pornography, escort services, “adult dating” marketplaces, non-consensual content, or any content depicting minors (anyone under 18) in any sexualized context. Content that depicts or solicits the sexual abuse of minors (CSAM) results in immediate termination and reporting to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.
  • Regulated and high-risk goods. Firearms, ammunition, explosives, controlled substances, drug paraphernalia, tobacco and vaping products, and alcohol sales outside of licensed brick-and-mortar contexts.
  • Gambling and games of chance. Online gambling, fantasy sports played for money, sweepstakes, lotteries, or any other game of chance where the player risks money or other items of value.
  • Multi-level marketing and get-rich-quick schemes. Multi-level marketing (MLM), pyramid schemes, get-rich-quick schemes, pre-paid debit card schemes, and any business model whose primary purpose is recruiting new participants rather than delivering goods or services to end customers.
  • Cryptocurrency businesses. Cryptocurrency exchanges, initial coin offerings (ICOs), NFT marketplaces, or any business whose principal product is cryptocurrency-denominated. We do not currently support crypto businesses on the platform.
  • Regulated financial services. Payday lending, debt collection, debt consolidation, credit repair, and similar regulated financial services. The compliance overhead of these categories exceeds what we can support today.
  • Counterfeit and IP-infringing goods. Counterfeit goods, replica designer items, knock-off pharmaceuticals, and any merchandise that infringes another party's intellectual property rights.
  • Hate speech and violence. Content that incites violence against protected groups, content promoting terrorism, content depicting graphic violence outside of news or educational contexts, and any content that violates applicable hate-speech laws.
  • Spam, phishing, and malware. Sending unsolicited bulk email (spam) in violation of CAN-SPAM, TCPA, GDPR, CASL, or comparable laws; phishing or credential harvesting; distributing malware, viruses, worms, ransomware, or any malicious code; harvesting personal data without consent.
  • Misrepresentation and fraud. Misrepresenting your business identity, the services you offer, your pricing, or any material fact; bait-and-switch tactics; card testing; stolen-card use; synthetic identity creation; chargeback fraud; or any practice intended to defraud customers or our Payment Processor.
  • Unauthorized resale of the platform. Reselling the Services or any of their features without our written authorization, including white-label resale and reseller arrangements.
  • Platform abuse. Reverse-engineering the Services, scraping at a rate that degrades performance for other customers, bypassing rate limits or feature flags, probing for vulnerabilities outside of an authorized disclosure program, or otherwise interfering with the normal operation of the Services or our Payment Processor.

Account Security Obligations

  • Keep your account credentials confidential. Use a strong, unique password and enable two-factor authentication where available.
  • You are responsible for all activity that occurs under your account, including activity by any sub-users or team members you have invited.
  • Notify us at security@bigspawn.com within 24 hours of any suspected unauthorized access to your account or compromise of your credentials.

Rate Limits and Fair Use

Reasonable use of API endpoints, storage, bandwidth, and other resources is subject to the limits of your subscription plan and to fair-use thresholds we publish from time to time. Excessive automated traffic, scraping, or other use patterns that disproportionately consume shared resources may be throttled, rate-limited, or blocked.

If you anticipate unusually high traffic or load (for example, a launch promotion or migration), please contact us in advance at support@bigspawn.com so we can plan capacity together.

Reporting Violations

To report a suspected violation of this AUP, email abuse@bigspawn.com. We aim to acknowledge abuse reports within 48 business hours. Reports relating to suspected CSAM, terrorism, or imminent threats to life are escalated and investigated immediately.

For copyright or other intellectual-property concerns, please follow the DMCA notice-and-takedown process described in our Terms of Service.

Enforcement

  • Tiered response. For less severe issues we will typically issue a written warning, give you a reasonable opportunity to remediate, and then suspend the account if the violation is not cured.
  • Immediate termination. Severe violations, including (without limitation) CSAM, terrorism-related content, large-scale fraud, sustained network abuse, or activity that places the platform or its other customers at material risk, result in immediate termination without prior warning and may be reported to law enforcement and regulatory authorities.
  • Cooperation with Payment Processor. Where a violation affects payments handled by our Payment Processor, we may share information necessary to investigate the violation and to comply with the Payment Processor's acceptable-use policy and card-network rules.

Updates to This Policy

We may update this AUP from time to time to reflect new risks, regulatory requirements, or changes in our Payment Processor's acceptable-use policy. Material changes will be announced by email to the address on your account and via a banner on the dashboard before they take effect. Your continued use of the Services after the effective date of an update constitutes acceptance of the updated policy.
